TERMS AND CONDITIONS

  1. DEFINITIONS
    1. “CL” means Cumberland Lodge  whose registered and principal trading address is Cumberland Lodge, The Great Park, Windsor, Berkshire SL4 2HP. Registered in England company number 5383055. Registered charity number 1108677. VAT registration number GB 864 4479 92.  
    2. “Third Party” means a party other than you and CL. 
  2. GENERAL
    1. These terms and conditions relate to the sale of goods and services (including tickets), making voluntary donations, and the use of CL’s website generally.  
    2. Nothing in these terms and conditions is intended to affect your statutory rights.   
  3. ACCURACY AND ALTERATIONS
    1. We try to ensure our website is kept up-to-date and accurate. However, we do not guarantee the completeness, accuracy, reliability, suitability or availability of this website and any of its contents. Any reliance you place on this information is at your own risk.
    2. We retain the right to make any alterations to details about the events and other work advertised on this website. We will make all reasonable efforts to inform people affected by such changes. 
  4. LIABILITIES OF CL
    1. Subject to clause 4.3 below, CL (or any relevant Third Party) will only be liable to you for direct and foreseeable losses arising as a result of: 
      1. a breach of these terms and conditions; or 
      2. any negligent act arising under or in connection with the Contract. 
    2. CL (or the relevant Third Party’s) total liability under clause 4.1 above shall be limited to the total paid value for any goods or services purchased.
    3. Nothing in this clause 4 excludes or limits liability for death, personal injury or fraud. 
    4. CL (or any relevant Third Party) will not be liable in any way if it is prevented from performing its obligations under or arising from any Contract due to any factors which are beyond its reasonable control. Without limiting the foregoing, the following shall be regarded as causes beyond its reasonable control:
      1. acts of God, which include earthquakes, cyclones, storms, flooding, fire, disease, fog, snow or frost;
      2. force majeure which includes war, accidents, acts of public enemies, strikes, embargoes, perils of the air, local disputes and civil commotions;
      3. power failure and failure of sound or lighting equipment. 
  5. WEBSITE USE
    1. CL’s website is for your own personal and non-commercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer or sell any information obtained from CL’s website.
    2. The contents of the CL’s website, including any software, are protected by intellectual property rights and other related rights. No part of CL’s website may be reproduced in any form (electronically or otherwise) without the prior consent of CL. 
    3. You are not permitted to link to or use all or any part of CL’s website for any purpose which is unlawful, defamatory, harmful, obscene or objectionable. 
    4. You are not permitted to transmit anything which, in CL’s opinion, harms CL’s business or in any way offends other users or persons. 
    5. You are not permitted to alter the CL’s website in any way. 
    6. You must not post onto or transmit to CL’s website any material containing software viruses or files which may damage or disrupt the good working order of computer or telecommunications equipment. 
    7. CL reserves the right to refuse to post onto or remove anything from its website which, in CL’s opinion, is objectionable or does not comply with these terms and conditions. CL shall not in any way be liable for such actions.
    8. CL may record, preserve, trace and disclose anything which has been transmitted to, from or via the CL’s website where required by law or where CL is acting in good faith.
    9. If you create, or are provided with, a username, password or any other piece of information as part of CL’s security procedures, you must treat this information as confidential. You must not disclose this information to any third party. 
  6. TICKET SALES
    1. These conditions relate to the sale of tickets for performances, workshops and other events made through this website. If you are redirected by us to a Third Party website to purchase to make our purchase, please refer to their terms and conditions.
    2. If you book tickets on behalf of others, you accept these terms and conditions on behalf of all members of the group and are responsible for all payments due from the party.
    3. Only persons who are at least 18 years of age are permitted to book tickets.
    4. Please check dates and times before completing your booking as it may not always be possible to rectify mistakes.
    5. We reserve the right to limit the number of tickets that be booked by a single person (a booking limit).
    6. Occasionally we may introduce discounts and special offers, and these cannot be applied to tickets already purchased. Only one discount can apply to any one ticket.
    7. It is your responsibility to inform us of any change to the contact address, telephone number or email address you provide us with at the time of ordering.
    8. Tickets may not be resold or offered for resale a) at a profit, b) to any ticket agencies c) at face value where the event is by invitation only or a workshop activity.
    9. Any resold tickets of those offered for resale in breach of the above will be cancelled and secondary buyers will not be admitted.
    10. Except where otherwise indicated, ticket(s) are non- exchangeable and non- refundable.
    11. If a long-term illness or injury prevents you taking part in workshops, classes or other courses, the value of your purchase may be refunded at CL’s discretion, or may be issued as credit for future purchases. This does not include minor illness or holidays, and does not extend to non-attendance at performances or other events.
  7. DONATIONS
    1. Donations made to CL are non-refundable as per charity law, except in exceptional circumstances.
    2. Donations made through Third Party platforms are subject to their terms and conditions.
  8. REFUNDS
    1. Where a purchase is cancelled by us, or a purchased performance workshop or other event is rescheduled by us, or cancelled or rescheduled due to circumstances beyond our control, or where there is a material change to the goods or services purchased, you will be entitled to claim a refund from us in accordance with this clause.
    2. A material change is a change which, in our reasonable opinion, makes the purchase materially different to what purchasers of the ticket, taken generally, could reasonably expect.
    3. The refund amount equals the price paid by you to us for your purchase, including any applicable per ticket booking fee. Refunds shall only be made to the person who purchased the tickets and via the same payment method, or as credit for future purchases.
    4. Credit notes are valid for 12 months from date of issue
    5. These Terms and Conditions do not and shall not affect your statutory rights as a consumer. For further information about your statutory rights contact Citizens Advice, or the Department for Business Innovation and Skills.
  9. SAFETY AND ENJOYMENT
    1. CL (or the relevant Third Party) reserves the right to refuse admission and may request any ticket holders to leave (taking any such appropriate action which may be necessary to enforce this right) before or during performances, workshops, events etc. We ask our patrons to treat our staff, and other patrons with respect and kindness. Anyone who does not uphold this culture will be asked to leave. 
    2. Latecomers will be asked to wait until a suitable time before being admitted.
    3. CL (or the relevant Third Party) may have to conduct security searches to ensure the safety of patrons and staff. If you do not permit a search to be undertaken, you will not be admitted. 
    4. We normally restrict the use of mobile phones and other electronic equipment, asking for them to be switched off (or silenced). We will advise you of the restrictions applying to your attendance.
    5. Unless you have been advised otherwise, guests are permitted to take photos or film for personal, non-commercial use, provided it does not disrupt others’ enjoyment of the event, excludes individuals who have not consented to being filmed or photographed, and does not breach the Chatham House Rule (if applicable). Commercial photography or filming is strictly prohibited without prior written permission from CL.
    6. CL and any authorised Third Parties may carry out general filming, photography and/or sound recording before, during and after events. You will be asked at the point of booking whether you consent to be included in any filming, photography, or sound recording, as a participant or member of the audience. CL reserves the right to use the photograph(s) and/or footage, and any reproductions of the photograph(s) and/or footage may be used for all general purposes including, without limitation, online, in print, and for media and marketing materials, whenever CL chooses to do so.     7. You are responsible for your own property and bring personal items to our events at your own risk. CL will not be held responsible for any loss, theft or damage of your own personal belongings, other than that caused as a result of our own negligence or other breach of statutory duty. Any lost property will be kept for one month and donated to charity thereafter.
  10. LINKS TO THIRD PARTY SITE
    1. CLs website may contain hyperlinks to websites operated by parties other than CL. The operation of such websites is outside CL’s control and you proceed at your own risk. CL does not endorse or sponsor and is not liable for the products, services or content you access through any linked site.
  11. DATA PROTECTION
    1. CL will collect, use, store and disclose your personal details in accordance with our Privacy Policy which can be accessed on this website. 
    2. We will process your personal data in accordance with our Privacy Policy
    3. We may change these terms and conditions from time to time by amending this page. By continuing to use this website you accept the version of the terms and conditions current at the time of your use. Changes to these terms and conditions will not affect any order from you that we have already accepted.

  13. ENTIRE AGREEMENT
    1. All the terms of any Contract are contained or are referred to within these terms and conditions.
  14. SEVERABILITY
    1. If any part of these terms and conditions is held to be unenforceable this will not affect the enforceability of the remaining provisions.  
  15. THIRD PARTIES
    1. Nothing contained in any Contract is intended to be enforceable pursuant to the Contracts (Rights of Third Parties) Act 1999 by any third party. 
  16. GOVERNING LAW
    1. These terms and conditions and any Contract concluded incorporating these terms and conditions shall be governed by English law and all disputes shall be submitted to the exclusive jurisdiction of the English courts.
